2. Acceptance of Terms

By engaging our services or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any provision, you should not engage our services or use our website.

You must be at least 18 years of age and have the legal capacity to enter into binding contracts under Hong Kong law. If engaging services on behalf of an entity, you represent that you have authority to bind that entity to these terms.

We provide legal services in the field of estate planning, including:

  • Related legal advice and documentation

Service availability may vary based on your circumstances and our capacity. We reserve the right to decline engagements that fall outside our expertise or where conflicts of interest exist.

4. Client Responsibilities

As a client, you agree to:

  • Respond promptly to our requests for information or documentation
  • Inform us of any changes in your circumstances relevant to your matter
  • Review draft documents carefully and provide feedback within reasonable timeframes
  • Comply with our reasonable instructions regarding document execution and witnessing

  • Pay fees and disbursements in accordance with agreed terms

Failure to fulfill these responsibilities may affect the quality of services we can provide and could result in delays or additional costs.

5. Professional Conduct

Our practice is governed by professional conduct rules established by The Law Society of Hong Kong. These rules require us to:

  • Maintain confidentiality of client information
  • Act in your best interests within the bounds of law and professional ethics
  • Avoid conflicts of interest
  • Maintain appropriate professional indemnity insurance
  • Comply with anti-money laundering regulations

These professional obligations may, in limited circumstances, prevent us from acting on your instructions or require us to decline or withdraw from representation.

6. Fees and Payment

Fee Structure

Our fees are based on the nature and complexity of services provided. Fee information is communicated during initial consultations and confirmed in engagement letters. Standard service pricing is:

  • Will Preparation: HKD 1,950
  • Trust Establishment: HKD 9,360
  • Estate Administration Support: HKD 14,040

Payment Terms

Payment is typically required upon completion of services or in accordance with milestone billing for complex matters. We accept payment by bank transfer, cheque, or other methods as agreed.

Disbursements

You are responsible for reimbursing reasonable disbursements incurred in your matter, including court fees, registration fees, search fees, and expenses for external consultants where necessary.

7. Intellectual Property

Documents prepared for you remain your property once fees are paid. However, our working papers, research materials, and internal documentation remain our property.

Content on our website, including text, graphics, logos, and design elements, is protected by intellectual property rights. You may not reproduce, distribute, or create derivative works from website content without our written permission.

We provide professional legal services with appropriate care and skill. However, we cannot ensure specific outcomes or results. Estate planning involves consideration of complex legal provisions and individual circumstances that may affect how documentation operates in practice.

10. Termination

You may terminate our engagement at any time by written notice. You remain responsible for fees for work performed up to the termination date and any reasonable wind-down costs.

We may terminate our engagement if:

  • Professional conduct rules require us to do so
  • You fail to pay fees when due
  • You fail to provide necessary information or cooperation
  • Continuing the engagement would place us in breach of legal or professional obligations

Effects of Termination

Upon termination, we will provide you with documents and information you are entitled to receive. We retain the right to hold documents until outstanding fees are paid, except where professional rules require us to release them.

11. Dispute Resolution

Governing Law

These Terms and Conditions are governed by the laws of Hong Kong. Any disputes will be subject to the exclusive jurisdiction of Hong Kong courts.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment
